1. Who we are
Kaizen is a full-service marketing agency in Bogotá. This site and the services you hire through it are provided by:
2. Use of the site
By using this site, you accept these terms. You may browse it, request quotes and contact us freely. You may not copy its content for commercial purposes, attempt to breach its security, send spam through its forms or use it in any way contrary to law.
3. Information and prices
- Prices on the site are fees in Colombian pesos (COP) or US dollars (USD). They show a “from” amount and a typical range depending on the scope: they are for guidance only. The binding price is the one in the written proposal or quote.
- They do not include third-party costs, such as ad spend, domains, hosting, licenses, airfare or travel expenses, unless the proposal states otherwise.
- When we say that our prices are 10% below the market, we are referring to the study of rates published by agencies and freelancers in Colombia and the United States that we conducted in October 2026: every “from” price came out at least 10% below that study's average.
- Cases and testimonials marked “Example” are illustrative and do not correspond to real clients.
4. How we contract
- Request: you tell us what you need through the site, WhatsApp, email or a call.
- Proposal: we send you a written quote with the scope, deliverables, price, taxes, payment method, timelines and validity period.
- Acceptance: you accept it expressly: by signing it, by approving it through the link, or by email or WhatsApp. These messages are valid as a contract (Law 527 of 1999) and we confirm receipt no later than the following day.
- Start: we begin upon receiving the deposit, unless the proposal states otherwise.
5. Payments and billing
- We accept credit and debit cards, PSE, Nequi, Botón Bancolombia and cash at banking agents (through Wompi), as well as bank transfers, Bre-B keys, money transfers and PayPal for payments in dollars.
- Unless otherwise agreed, projects are paid 50% to start and 50% upon delivery. Monthly plans are paid monthly in advance.
- Before paying, you see the breakdown of the charge with its taxes. When you pay online, you receive your receipt instantly.
- We issue the document that corresponds to our tax regime: an electronic invoice or an invoice (cuenta de cobro).
- If a payment is late, we may pause the work and charge late-payment interest at the maximum legal rate certified by the Financial Superintendence of Colombia.
6. Revisions, changes and timelines
- Each deliverable includes two rounds of revisions. Additional rounds and changes outside the scope are billed by the hour, with prior notice: $100.000 per hour.
- Delivery timelines run from when we receive the deposit, the information and the necessary access. Delays in your approvals move the schedule.
- If a project goes without a response from you for 30 days, we will pause it and invoice the work performed up to that point.
7. Right of withdrawal
If you are a consumer under Law 1480 of 2011 and you contracted remotely (through the site, WhatsApp or email), you may withdraw within the 5 business days following the execution of the contract, by writing to us through PQRS with the type “Withdrawal”. We will refund your money within a maximum of 15 calendar days, without deductions or withholdings.
There is no right of withdrawal when the service has already begun with your express consent (for example, when you ask us to start immediately), nor for deliverables made to your specifications, as permitted by article 47 of Law 1480.
8. Payment reversal
If you paid by card, PSE or another electronic payment method and you were the victim of fraud, the transaction was not requested, or the service was not provided or does not match what was contracted, you may request a payment reversal under article 51 of Law 1480. File your claim with us and notify the issuer of your payment method within the 5 business days after you become aware of the problem.
9. Cancellation and termination
- You may terminate a project at any time. You pay for the work performed up to that day and for the commitments already made with third parties; if the deposit exceeds the work performed, we refund the difference.
- Monthly plans are canceled with 30 days' notice.
- We may terminate the contract in the event of a serious breach, such as non-payment or the use of the service for illegal purposes.
10. Quality and warranty
We are responsible for the quality and suitability of what we deliver. If a deliverable has an error attributable to Kaizen (for example, a bug in a website's code), we will fix it at no cost if you notify us within 30 days after delivery.
In advertising, SEO and social media, we commit to the agreed work and processes, but we cannot guarantee sales, search engine rankings or exact results, because they depend on factors we do not control: the market, the platforms, the budget and the competition.
11. Intellectual property
- When you pay the full amount, we assign to you in writing the economic (copyright) rights in the final deliverables: reproduction, public communication, distribution, transformation and making available, worldwide and for the legal term, unless the proposal states otherwise.
- The authors' moral rights are respected, as required by law. We agree that you may modify and adapt the works for your brand.
- Source files (for example, editable design files or video projects) are delivered when the proposal includes them.
- Third-party fonts, music, stock image libraries, plugins and templates are used under their own licenses, which we will indicate to you.
- We may show the work, your name and your logo in our portfolio, unless you ask us in writing not to or the project is confidential.
12. Your commitments
- Provide truthful information and materials to which you hold the rights.
- Have the authorization of the people who appear in your photos and videos.
- Be responsible for the claims made about your products in advertising: they must be truthful and verifiable.
- In influencer campaigns, allow the commercial relationship to be clearly disclosed (for example, with “Advertising”), as required by the Superintendence of Industry and Commerce.
- Pay advertising spend directly to the platforms, unless otherwise agreed.
13. Drones, music and platforms
- Drone flights are carried out by authorized operators in accordance with the Colombian Civil Aviation regulations (RAC 100). They depend on permits, zones and weather; if the weather does not allow it, we reschedule at no cost.
- Music in videos is used under a license for the agreed use. If you provide your own music, you must hold the synchronization license.
- Meta, Google, Shopify, WhatsApp and other platforms have their own rules. We are not responsible for their changes, outages or account blocks that are not caused by our work.
14. Liability and confidentiality
Our liability for a service is limited to the amount paid for that service, except in cases of willful misconduct or gross negligence and except for the rights the law grants to consumers, which cannot be limited. We are not liable for force majeure or acts of God.
We keep confidential the information about your business that we learn through the project, and we use it only to provide you with the service.
15. Requests, complaints and claims
You may submit requests, complaints, claims, and warranty or withdrawal requests through PQRS: we give you a filing number with the date and time, and we respond within a maximum of 15 business days. You may also turn to the Superintendence of Industry and Commerce (SIC).
16. Governing law
These terms are governed by the laws of Colombia. If a disagreement arises, we will first seek to resolve it directly for 30 days. If that is not achieved, the matter may be brought before the courts of Bogotá or, if you are a consumer, before the Superintendence of Industry and Commerce. For clients abroad, the terms of the proposal apply.
17. Changes and effective date
We may update these terms. Changes do not affect contracts already accepted. Version 1.0, effective as of October 21, 2026.
